These Creator Terms apply when you use FWDLink to sell, take payment, or receive money. They are in addition to our Terms of Service, which continue to apply to everything you do on the Platform. Where these Creator Terms and the Terms of Service conflict on a selling or payment question, these Creator Terms govern.
FWDLink is operated by WorkFotos LLC, a Florida limited liability company doing business as FWDLink (“FWDLink,” “we,” “us”).
1. Words we use
- Creator — you, when you offer anything for sale or accept money through the Platform. This includes service businesses invoicing customers and creators selling content.
- Fan — a person who buys, subscribes to, tips, or unlocks something you offer. Also called a buyer.
- Offering — anything you make available for money: memberships, tips, digital products, paid messages, paid libraries, one-time unlocks, paid access to a page or album, and CRM items such as estimates, invoices, work orders, deposits, and bookings.
- Depicted Person — any identifiable person who appears in content you publish, including you.
2. Who can be a Creator
To sell on the Platform you must:
- Be at least 18 years old and able to enter a binding contract.
- Provide accurate legal identity, business, and tax information to us and to our payment partners, and keep it current.
- Complete any identity or business verification our payment partners require before funds can be released to you.
- Not be located in, ordinarily resident in, or operating from a place where we do not offer the relevant service. See Availability & Geographic Restrictions.
Giving us false, incomplete, or misleading identity or tax information is a material breach of these Creator Terms. It can result in withheld funds, closure of your selling features, account termination, and reporting to payment partners or authorities where the law requires it.
3. You are the seller
You sell to your Fans. We do not. FWDLink provides the software and the payment connections; it is not the seller of your Offerings unless we say so in writing for a specific transaction. You decide what you offer, how you describe it, and what it costs, within the limits of these Creator Terms, our Acceptable Use Policy, and the law.
You are responsible for:
- Describing every Offering accurately, including what a Fan receives and for how long.
- Delivering what you sold, on the terms you advertised.
- Responding to your Fans about their purchases.
- Any promise you make outside the Platform. We are not bound by side agreements between you and a Fan.
4. What you may sell
Your Offerings must comply with the Acceptable Use Policy, which contains the full list of prohibited content and prohibited items. In particular you may not sell, promise, or advertise:
- Anything unlawful where you are, where the Fan is, or where the content is hosted.
- Content depicting anyone under 18, in any form, including drawn, fictional, or AI-generated depictions.
- Intimate content of a person who has not consented to it being published and sold.
- In-person sexual services, escorting, or any commercial sexual exploitation.
- Content you do not own or have the rights to sell.
- Access to content hosted elsewhere as a way of avoiding these Creator Terms or the fee schedule.
You warrant, every time you publish or sell, that you hold the rights, licences, consents, and releases needed for that Offering, and that every Depicted Person is at least 18 and has consented to publication and to sale.
5. Pricing and what the Fan pays
You set your prices in US dollars. The Fan pays the price you list. We do not add a surcharge to the Fan at checkout. Our fee and the payment processing cost come out of the sale proceeds, as set out in section 6.
Locked and unlockable Offerings have a minimum price of $5. This is enforced on our servers, so a lower price will be refused. Fixed card costs make smaller amounts uneconomic for both of us.
Prices exclude taxes unless you state otherwise. Section 10 covers taxes.
6. Fees and how a sale is split
6.1 The two amounts that come out of a sale
Every sale has two separate deductions, and they are not the same thing:
- The FWDLink platform fee — a percentage of the sale, listed below. This is our revenue.
- Payment processing cost — what the card networks and the payment processor charge to move the money. This is deducted from your proceeds at cost. FWDLink does not absorb it and does not keep it. We do not promise any particular processing rate, because we do not set it.
Deductions are applied in this order:
Gross sale price − FWDLink platform fee − payment processing cost − reserve (if any) = your net earnings
6.2 Standard creator fee schedule
Applies to tips, memberships, digital products, paid messages, paid libraries, and standard paid access.
- Starter — 7% of the sale.
- Pro — 3% of the sale.
- Business — 1% of the sale.
A Founding Creator offer, where you have one, reduces the Starter rate to 5% for 12 months on standard creator sales.
6.3 CRM and booking payments
- Starter — 2% of each successful online payment on estimates, invoices, work orders, deposits, and bookings, capped at $25 per payment.
- Pro and Business — no FWDLink fee on those payments.
- Payments you collect in cash or by cheque carry no FWDLink fee.
6.4 Changes to fees
We may change the fee schedule. We will publish the change and give reasonable notice before it takes effect. The rate that applies to a sale is the rate in effect when the Fan pays. Your subscription plan price is separate and is governed by the Refund & Cancellation Policy.
7. Your balance and when you get paid
7.1 How payouts work
Creator sales and CRM payments settle through our standard payment partner (Stripe, including Stripe Connect) on that partner's schedule and under its terms. You must have a connected, verified payout account before money can reach you.
Balances shown in your dashboard are an estimate of what you have earned. They are not a guarantee of payment until the money is actually paid out and clears.
7.2 When we can delay, withhold, or reverse a payout
We may delay, suspend, reverse, or withhold a payout where:
- Your balance is negative (see section 8.4).
- Identity, business, or tax verification is incomplete or has failed.
- We reasonably suspect fraud, account takeover, or money laundering.
- There is an open dispute, investigation, or content report affecting the sales in question.
- You are in breach of these Creator Terms or the Acceptable Use Policy.
- A payment partner, court, or authority requires it.
- There has been an error in crediting your balance.
We will tell you when we do this and, where we can, what would resolve it. Some holds cannot be explained in detail while an investigation or a legal process is open.
8. Refunds, chargebacks, and negative balances
8.1 Refunds
The Refund & Cancellation Policy sets out when a Fan can get money back. When a sale of yours is refunded:
- The refunded amount is deducted from your balance.
- We return our platform fee on that sale.
- Payment processing cost is returned to you only if the processor actually returns it to us. Processors frequently keep it, and we cannot credit you money we did not get back.
- The Fan's access to what they bought is revoked.
8.2 Chargebacks
A chargeback is a Fan asking their bank to reverse a payment. When one is filed against a sale of yours, the full sale amount plus the processor's chargeback fee is deducted from your balance, and the Fan's access is revoked. We pass the chargeback fee through at the cost the processor reports to us.
We may ask you for evidence to contest a chargeback. Providing it promptly and accurately is your best chance of keeping the money, but the bank decides, not us.
8.3 Settlement adjustments
Processing cost is sometimes booked at an estimated rate at the time of sale and corrected later when the processor's settlement report arrives. When that happens, the difference is credited or debited to your balance and shown in your ledger. Our platform fee is not recalculated.
8.4 Negative balances
If refunds, chargebacks, and fees exceed what you have earned, your balance goes negative. Payouts are suspended while your balance is negative. This is not something we can switch off on request. New earnings are applied against the negative balance first. If you close your account with a negative balance, the amount remains owed to us and we may set it off against any other amount we hold for you or seek to recover it.
9. Dispute rates and enforcement
Card networks judge merchants on dispute rates, and a high rate puts the whole Platform's ability to take payments at risk. We monitor your dispute rate as a proportion of your completed sales.
- Above our review threshold, we may place your account on a permanent reserve.
- Above our termination-review threshold, or above a set number of disputes regardless of rate, your account is flagged for termination review and payouts are suspended while we look at it.
These thresholds are set from our payment processor's requirements and can change when those requirements change. Sales volume must reach a minimum before rate-based rules apply, so a single dispute on a handful of sales does not trigger them.
10. Taxes
You are responsible for your own taxes. That includes income tax, self-employment tax, sales tax, VAT, GST, and any other tax that applies to what you sell and where you sell it. We do not give tax advice.
- We may require tax documentation before releasing funds — for US persons, a Form W-9; for others, the equivalent our payment partner requires.
- Where the law requires it, we or our payment partners will report your earnings and issue tax forms, such as a Form 1099-K.
- Refusing or failing to provide required tax documentation will stop your payouts.
- The amounts shown in your dashboard are not tax advice and may not match a tax form, which is prepared on different rules.
11. Identity verification
Selling requires verification. Before funds can be released, you must complete the identity and business verification our payment partner requires. We may also ask for a government-issued photo ID and a selfie for payouts, KYC, and fraud prevention, as described in the Age Verification Policy.
You must submit your own documents, for yourself. Submitting someone else's identity documents, or documents that have been altered, is a material breach and may be a criminal offence. We may re-verify you at any time, and may suspend selling features until re-verification is complete.
12. People appearing in your content
Sexually explicit content and pornography are prohibited on FWDLink. You may not publish or sell that material. See the Acceptable Use Policy and the 18 U.S.C. § 2257 Statement.
For any content you publish, you represent that every Depicted Person is at least 18 and has given any consent required by law for publication and, where applicable, sale. We may remove content, suspend selling, or suspend an account where:
- A Depicted Person tells us they did not consent, or withdraws consent.
- Content appears to involve a minor.
- We cannot identify who is shown in the content and there is a credible concern.
- Content otherwise violates our policies.
A Depicted Person can request removal at any time through Report Content & Takedown Requests. When they do, we remove the content from public view. You will not be able to reverse that by pointing to a signed release.
13. Content, moderation, and strikes
We may review, label, age-restrict, restrict, remove, or refuse any content or Offering, and may suspend selling features or an account. We use both automated tools and human review. Nothing is removed by an automated tool alone; a person makes the removal decision, except where content is restricted temporarily while an urgent report is triaged.
Enforcement, strikes, and how to appeal are set out in the Complaints & Appeals Policy.
Where content is removed for a serious violation, we may also withhold earnings from the sale of that content, revoke the Fans' access and refund them, and report the matter where the law requires it.
14. Your licence to us
You keep ownership of your content. Section 4.2 of the Terms of Service sets out the licence you grant us to host, display, deliver, and process it so the Platform can work. That licence covers what we need to sell on your behalf: showing previews, delivering purchased content to the Fans who bought it, processing payments and refunds, and keeping the records we are required to keep.
15. Exclusivity, promotion, and off-platform payment
We do not require exclusivity. You may sell the same content elsewhere.
You may not, however, use the Platform to route a Fan to an off-platform payment in order to avoid our fees on an Offering you advertised here. Directing Fans to pay you outside the Platform for content you promoted on the Platform is a breach of these Creator Terms, and we may suspend selling features for it.
16. Suspension and termination
Either of us can end this arrangement. You can stop selling at any time by turning off your Offerings, and can close your account as described in the Privacy Policy.
We may suspend or terminate your selling features or your account where:
- You breach these Creator Terms, the Terms of Service, or the Acceptable Use Policy.
- Your dispute rate crosses the thresholds in section 9.
- Verification requirements are not met.
- A payment partner requires it, or will no longer process for you.
- We are required to by law, or to protect Fans, Depicted Persons, or the Platform.
On termination, we will pay out an available, non-negative balance once any open disputes have run their course, subject to verification and to any amount you owe us. Where the law lets us, we may set off what you owe against what we hold.
Sections that by their nature should survive — fees already incurred, negative balances, indemnity, limitation of liability, and taxes — survive termination.
17. Your promises to us
You represent and warrant, on a continuing basis, that:
- Everything you tell us about your identity, business, location, and taxes is true.
- You own or are licensed to sell everything you offer.
- Every Depicted Person is at least 18 and has consented to publication and sale.
- Your Offerings and your conduct comply with the law where you are and where your Fans are.
- You are not a person or entity subject to sanctions, and you are not acting for one. See Availability & Geographic Restrictions.
18. Indemnity
You will defend, indemnify, and hold harmless FWDLink, WorkFotos LLC, and their officers, employees, and agents against any claim, demand, loss, liability, damage, fine, cost, or expense (including reasonable legal fees) arising out of or relating to: your Offerings and content; a Depicted Person's claim about content you published; your breach of these Creator Terms or of any policy incorporated into them; your taxes; your dealings with a Fan; or your violation of any law or of any third party's rights.
19. Liability
The limitations of liability and disclaimers of warranty in sections 19 and 20 of the Terms of Service apply to these Creator Terms in full. In particular, we do not guarantee any level of sales, earnings, visibility, or audience, and we are not liable for a payment partner's decision to hold, delay, reverse, or decline a payment or payout.
20. Changes
We may update these Creator Terms. Material changes will be notified to you and reflected in the “last updated” date above. The version in effect when a sale is made governs that sale. Continuing to sell after a change takes effect means you accept it.
21. Governing law and disputes
Section 22 of the Terms of Service — governing law, informal resolution, binding arbitration, class action waiver, and the time limit on claims — applies to these Creator Terms without change.
